By downloading, installing, or using the Scholarly mobile application ("App," "Service," or "Scholarly"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Ryan Schefske ("we," "us," or "our").
Scholarly is an iOS application designed to help users improve their reading skills through various reading modes and features:
Free Tier: - Access to all core reading modes - Limited reading history (last 10 items) - Limited statistics (last 7 days) - Advertisement-supported experience
Scholarly Pro (Subscription): - Ad-free experience - Unlimited reading history (up to 50 items) - Complete statistics (up to 90 days) - AI-powered text summarization - Advanced statistics and analytics - Priority feature access
Scholarly does not require account creation. All data is stored locally on your device.
You agree to: - Use the App only for lawful purposes - Use the App for personal, non-commercial use - Comply with all applicable local, state, national, and international laws - Respect intellectual property rights
You agree NOT to: - Use the App to infringe on copyrights or trademarks of others - Input or scan copyrighted material that you do not have rights to use - Reverse engineer, decompile, or disassemble the App - Attempt to gain unauthorized access to the App's systems or networks - Use automated systems or software to extract data from the App - Remove, alter, or obscure any proprietary notices from the App - Use the App in any way that could damage, disable, or impair the App - Resell or commercially exploit the App or its features
The App and its original content, features, and functionality are owned by Ryan Schefske and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Scholarly and associated logos are trademarks of Ryan Schefske. You may not use these trademarks without prior written permission.
The App integrates with third-party services: - Apple Foundation Models: For AI text summarization (on-device processing) - RevenueCat: For subscription management - Google AdMob: For advertising (free tier only)
Your use of third-party services is subject to their respective terms and conditions. We are not responsible for third-party services.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: - Warranties of merchantability - Fitness for a particular purpose - Non-infringement - Accuracy, reliability, or availability
We do not guarantee that: - The App will improve your reading speed or comprehension - The App will be uninterrupted, timely, secure, or error-free - AI summaries will be accurate or complete - Text recognition from scanning will be perfect
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR: - Any indirect, incidental, special, consequential, or punitive damages - Loss of profits, revenue, data, or use - Damages arising from your use or inability to use the App - Any damages exceeding the amount you paid for the App in the past 12 months
Scholarly is designed as a tool to assist with reading practice. It is not a substitute for professional educational services or medical advice for reading difficulties.
You may cancel your subscription at any time through your iTunes Account Settings. Cancellation takes effect at the end of the current billing period.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
We reserve the right to: - Modify or discontinue features with or without notice - Change subscription tier benefits with notice to active subscribers - Add new features or services
You may stop using the App at any time by deleting it from your device.
We reserve the right to: - Suspend or terminate your access to the App for violation of these Terms - Discontinue the App entirely with reasonable notice
Upon termination: - Your right to use the App ceases immediately - Subscription benefits end (subject to Apple's policies) - All data stored locally on your device remains until you delete the App
The App is controlled and operated from the United States. We make no representation that the App is appropriate or available for use in all locations. Access to the App from territories where its content is illegal is prohibited.
These Terms are governed by the laws of the United States and the state where the developer is located, without regard to conflict of law principles.
Any disputes arising from these Terms or use of the App should first be addressed through good-faith negotiation. If unresolved, disputes will be settled through binding arbitration in accordance with applicable law.
These Terms are between you and Ryan Schefske only, not with Apple Inc. Apple is not responsible for the App or its content.
We strive to make Scholarly accessible to all users. If you experience accessibility issues, please contact us.
Scholarly does not knowingly collect information from children under 13. The App is designed for general audiences. Parents and guardians are responsible for monitoring their children's use of the App.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Ryan Schefske regarding the App and supersede all prior agreements and understandings.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
